What are the legal requirements for pollution control in construction?
In Texas, construction activities are regulated by the Texas Commission on Environmental Quality (TCEQ). Pollution control laws and regulations set by the TCEQ must be followed in order to prevent environmental damage. Any construction project that involves the movement of earth, the demolition or alteration of structures, or the use of heavy machinery is subject to pollution control requirements. To ensure compliance, the TCEQ requires the implementation of dust control devices, such as water trucks and air filtration systems, during the construction process. In addition, construction sites must be managed in a manner that prevents sediment-laden runoff from entering nearby bodies of water. To prevent erosion and sediment runoff, construction companies must minimize the amount of exposed soil and create an effective plan for managing stormwater on-site. The TCEQ also requires that construction sites use best management practices (BMPs) to minimize the potential for pollution. BMPs are techniques that reduce the amount of pollutants released into the environment, such as limiting exposure to dust and dirt. Finally, depending on the type of project, a construction company may have to obtain certain permits to prevent water and air pollution. These permits and regulations are designed to protect public health and ensure that construction companies are following all relevant pollution control laws.
