Most commonly, the Kansas Consumer Protection Act, or KCPA, prevents businesses from engaging in unfair or deceptive practices when it comes to marketing and advertising. The Kansas Attorney General’s Office is the leading agency responsible for enforcement of the KCPA and consumer protection in Kansas. The KCPA specifically prohibits deceptive acts, rules, or practices in the course of conducting business. This includes sending unsolicited commercial emails that contain a false or misleading statement, or contain content that is unrelated to the primary purpose of the email. Additionally, it is illegal to use deceptive subject lines, or subject lines that are unrelated to the actual content of the email. The Attorney General’s Office encourages consumers to be aware of the practices prohibited by the KCPA and to report any unsolicited emails they receive that contain deceptive information.
