What is collaborative divorce law?

Collaborative divorce law is a form of alternative dispute resolution that is used to settle a divorce without going to court. It is an agreement between two parties to settle their divorce in a way that is mutually beneficial and less time-consuming and expensive than going through the court system. In North Dakota, collaborative divorce law is governed by the North Dakota Collaborative Divorce Law, which requires that parties in a divorce complete an informational process, hold at least two individual meetings, and obtain the services of two trained collaborative divorce attorneys. During the collaborative divorce process, each person is represented by their own attorney, and the attorneys work together to help the couple settle their divorce. The attorneys may provide legal advice, help the two parties come to an agreement, and offer their own consultation and advice. During the process, the attorneys are required to comply with the North Dakota Collaborative Divorce Law, including having joint meetings to negotiate the terms of the divorce. Any agreement must be in writing and must be approved by both parties before it is legally binding. At the end of the collaborative divorce process, the couple will be provided with a finalized written agreement that outlines all of the terms and conditions of the divorce. This agreement may be used in court as the divorce agreement if one party wishes to file the agreement in court. The goal of collaborative divorce law is to help a couple find an agreement that is beneficial to both parties and avoid the time, expense, and stress of a court-ordered divorce.
