What is the collaborative divorce process?

Collaborative divorce is an alternative to the traditional, adversarial divorce process. In Ohio, Collaborative Divorce Law is a process by which divorcing couples work together to create an amicable agreement that is in the best interest of both parties. In collaborative divorce, the couple and their attorneys commit to an open and respectful dialogue that seeks to reach an agreement without the need for a judge or litigation. The collaborative divorce process begins with both parties signing an agreement in which they promise to work together in good faith to reach a resolution. During the process, both parties will have independent attorneys present to help guide them through the process and ensure that everyone’s rights and interests are protected. The attorneys will then work with the couple to identify and discuss their respective needs and interests and work towards developing a mutually acceptable agreement. If the couple cannot come to an agreement, the attorneys can bring in a neutral third party, such as a financial expert or a child psychologist, to help the couple reach a resolution more quickly. After all of the issues have been addressed, the couple will have a chance to review the agreement. If both parties agree to the agreement, the attorneys will draft a settlement and file it with the court. Once the court has approved the settlement, it is binding and the divorce is finalized.
