What is the collaborative divorce process?

Collaborative divorce is an alternative to traditional court-based divorce. It is a voluntary process in which both parties agree to participate in out-of-court settlement negotiations in order to resolve all issues related to the divorce. In Texas, collaborative divorce requires both parties to sign a participation agreement which outlines the roles that the parties, their attorneys and other outside professionals such as mental health professionals, may take during the process. These roles may include providing legal advice, offering financial advice, and helping the couple reach an agreement. The collaborative divorce process begins with both parties entering into the agreement, which outlines a timeline for the process and any ground rules or expectations that have been agreed upon. The parties then prepare for negotiations by gathering the necessary financial information such as income, assets, debts, and other documents. They will also discuss the issues they want to address during the process such as parenting time and custody arrangements, child or spousal support, division of property, and any other issues that may arise during the process. The collaborative divorce process will then move to negotiating the terms of the divorce, with both parties working together to reach a resolution. During this process, both parties must be respectful and honest with their goals and expectations. Once an agreement is made, it is typically reviewed by the parties’ attorneys and then signed and submitted to the court to finalize the process.
