What is a collaborative divorce team?
A collaborative divorce team is a group of professionals that are brought together to help divorcing couples end their marriage amicably. This team includes a neutral divorce attorney for each spouse, a mediator and/or a financial neutral, and other professionals who may be needed such as a child specialist, or mental health coach. In North Carolina, collaborative divorce is an alternative to the traditional litigated approach. During a collaborative divorce, both spouses and their attorneys are committed to resolving the issues of the divorce out of court. The team works together to help both spouses come to an agreement that is satisfactory for both. This approach allows couples to reach a mutually acceptable resolution without costly and lengthy litigation. The team focuses on communication and cooperation to solve the issues. The neutral divorce attorneys provide legal advice to both spouses and make sure their rights are protected. The mediator and/or financial neutral facilitate negotiations, and provide services to both spouses such as dispute resolution, financial analysis and budgets, and parenting plans. Other professionals, such as a child specialist or mental health coach, can provide specialized services if needed. Overall, collaborative divorce is a process that allows divorcing couples to reach an agreement with the support of a team of trained professionals that can facilitate the resolution of their divorce in an amicable and efficient manner.
