How do I start the collaborative divorce process?
The process of a collaborative divorce in North Carolina begins when both parties agree to use the collaborative process as the means to end their marriage. Both parties must have their own independent attorneys who can represent their interests and negotiate for them. The first step is to meet with your respective lawyers. The lawyers will review the process and explain all the relevant laws. If both parties agree to proceed with the collaborative divorce process, they will then sign a Participation Agreement which outlines the obligations of both parties to the process. Once the Participation Agreement is signed, both parties will meet in a private setting with their respective attorneys and any other professionals who will be involved in the process. These professionals may include mental health professionals, financial advisers, and/or mediators. The goal of this meeting is to discuss the main issues of the divorce, such as alimony, child support, and division of assets. After the initial meeting, the parties will meet regularly to work out the details of their divorce settlement. During these meetings, the lawyers and other professionals may share information and offer advice. In some cases, the parties may need to agree to see a mediator for additional assistance in resolving their differences. Once all of the issues have been resolved, the attorneys will prepare the final settlement document, which is then signed by both parties.
