What are the limits to collaborative divorce negotiations?
Collaborative divorce is an alternative to litigation that is gaining popularity in California. It is a process wherein the spouses and their attorneys work together to come to an agreement regarding property division, spousal support, custody and other family matters. This process emphasizes cooperation and communication in order to reach an amicable resolution without engaging in litigation. However, there are limits to the collaborative divorce negotiation process. These limits include any form of physical or verbal abuse in the discussions. In addition, parties should avoid concealing assets or attempting to intentionally mislead the other party.
