Can a collaborative divorce be reversed?
In North Carolina, a collaborative divorce can potentially be reversed. This depends on the decisions you and your spouse have made before the divorce was finalized. Before a collaborative divorce is considered legally binding, you and your spouse must come to an agreement on all major issues, such as child custody, property division, spousal support, etc. Once all the terms of the divorce have been agreed upon, they must be signed by both parties and then filed with the court. The divorce is not finalized until all of the terms have been accepted by the court. If either of you change your mind before the court has accepted the agreement, the collaborative divorce can be reversed. The process of reversing the divorce is typically done through an attorney who can provide legal advice and guidance in order to ensure that the reversal will be accepted by the court. If the court has accepted the collaborative divorce agreement, the process of undoing the divorce becomes a lot more complicated. It is possible to reverse a collaborative divorce, but it is much harder to do so. In order to successfully reverse a collaborative divorce, both parties must still agree to the reversal and they must be able to prove to the court that there is good cause for undoing the divorce. The court may also require that the parties go through mediation to try and reach an agreement on any of the issues that would be affected by the reversal. If the collaborative divorce is successfully reversed, the parties will then have to start the collaborative divorce process over again in order to come up with a new agreement.
