How do I handle issues of alimony in a collaborative divorce?

When it comes to alimony, Mississippi law is quite clear: both parties must agree to the details. In a collaborative divorce, this agreement must be reached through negotiations between both parties. It is wise to hire a lawyer to make sure that your rights are safeguarded. When deciding on alimony in a collaborative divorce, both parties must make sure to consider all relevant factors, such as the length of the marriage, the respective incomes of both parties, and any pre-existing agreements made prior to marriage. Alimony can be arranged as either lump-sum payments, or regular payments over time. If an agreement cannot be reached, either party may be able to file for temporary alimony, known as pendente lite alimony, in order to provide financial support during the divorce proceedings. This type of alimony does not affect the final award when court proceedings occur. It is important for both parties to be aware that alimony in Mississippi is not necessarily permanent, but rather is dependent on both parties’ ability to maintain their respective lifestyles, along with any remarriage or cohabitation of either party. Once an agreement has been reached, both parties should sign a written agreement, or a Marital Dissolution Agreement, that outlines the details of the alimony. This document should be filed with the court in order to be approved and become legally binding.
