How does commercial law differ from criminal law?
Commercial law is a branch of law that regulates the conduct of business entities and commercial transactions. It is distinct from criminal law, which sets forth the punishments that may be imposed on people or companies for violating the law. In criminal law, individuals or companies are unlawfully breaking the law and the state seeks to punish those who do so by criminal proceedings. This can include fines, jail time, or other forms of punishment. In contrast, commercial law focuses more on the relationships between businesses and their customers, as well as the terms and conditions of certain products and services. It primarily concerns the enforcement of contracts, rules of competition, intellectual property rights, and other matters related to commerce and trade. To convict an individual or business of a criminal offense, the prosecution must prove its case beyond a reasonable doubt. In contrast, in commercial law only a preponderance of evidence is necessary, which is a much lower standard. Overall, commercial law is different from criminal law in that it focuses more on business relationships and transactions, whereas criminal law is centered on punishing those who break the law.
