What is the procedure for bringing legal action against someone?
In Florida, if you want to bring legal action against someone, you must first identify the correct court with jurisdiction over the case. Generally, you must file the action in the county where the other person lives or the event causing the dispute took place. Once the court has been determined, the plaintiff (the person bringing the action) must file a Complaint with the court. This document outlines the plaintiff’s claims and the remedy they seek. Once the Complaint is filed, the defendant (the person being sued) must be served with a summons. This is the document that informs the defendant they are being sued. After they have been served, the defendant must respond to the Complaint by filing an Answer. This document is their opportunity to respond to the claims laid out in the Complaint. After the defendant has answered, the court may enter “discovery” to give both sides the opportunity to gather evidence and develop their case. This can involve exchanging documents and depositions of potential witnesses. The court may also schedule a hearing for a judge to decide on a resolution. If the parties cannot come to a resolution, the case may continue to a trial, where a jury of citizens make the final determination.
