What is the law on anti-competitive practices?
In Delaware, anti-competitive practices are prohibited by the Delaware Antitrust Act. The law seeks to protect consumers from the negative effects of consumer interference, price-fixing schemes, and other anti-competitive practices. The Act explicitly states that any “unreasonable restraint of trade” is illegal. The Delaware Antitrust Act covers any agreements between competitors that limit competition, such as cases where two firms agree to split markets, limit production, or set prices. It also covers any agreements that prevent the entry of new competitors or limit their ability to compete. The Act also forbids businesses from using their economic power and market control to drive out competition. Companies cannot use their size to manipulate prices or interfere in other businesses’ operations. Businesses also cannot use their power to prevent smaller companies from succeeding or limit supply to raise prices and limit competition. The Act is enforced by the Delaware Attorney General. Any individual or business found to be in violation may be fined and/or be required to enter into a consent decree. The Delaware Antitrust Act is an important part of maintaining a fair and competitive marketplace in the state. The Act is designed to protect consumers by encouraging competition and providing a level playing field.
