What legislation governs the advertising of products and services?
In the District of Columbia, many of the laws that govern the advertising of products and services come from the Federal Trade Commission (FTC). Under their authority, the FTC enforces the FTC Act, which is a law that protects consumers from unfair and deceptive practices. This includes advertising and marketing practices. When businesses in DC advertise, they must follow the guidance from the FTC on topics such as truthfulness and disclosure. For example, businesses may not use deceptive language in advertisements and they must disclose any risks associated with the product or service. Additionally, businesses must be sure that all claims made in their advertisements are truthful and backed up by evidence. To help ensure compliance with the FTC Act, the DC government has also put in place the Consumer Protection Procedures Act of 1976. This act makes it illegal for any person, including businesses, to engage in unfair or deceptive trade practices. This includes false or misleading advertising and the use of deceptive, unfair, or unnecessary language in advertising. Finally, businesses must comply with the DC Municipal Regulations, which govern the form, content, and placement of advertising. The regulations state that all advertisements must be true and accurate, display an appropriate warning if necessary, and provide all required disclosures. Overall, the FTC Act, the Consumer Protection Procedures Act, and the DC Municipal Regulations all work together to protect the interests of DC consumers. These acts ensure that businesses in the district follow responsible and ethical practices when advertising their products and services.
