How do I register a trademark?

Trademarks are important aspects of any business, as they help distinguish one company’s products from another’s. In Oklahoma, registering a trademark requires one to file a trademark application with the United States Patent and Trademark Office (USPTO). Before filing, it is important to search online to make sure there are no other existing trademarks that conflict with yours. Additionally, the trademark must be unique and should not be merely descriptive or generic. To ensure your trademark application will be approved, it is important to provide the USPTO with a well-crafted description of your mark (known as a “specimen”). The specimen should include a description of how the mark is used in commerce, as well as any artwork or photographs that are associated with it. Once all of the necessary documentation is complete, the trademark will be officially registered and the applicant will receive a certificate of registration. Once registered, it is your responsibility to defend the trademark against infringement by other businesses. The trademark can be enforced or protected through cease-and-desist letters or through a formal lawsuit. Keeping accurate records and renewing the trademark every 10 years are also important steps in maintaining a registered trademark in Oklahoma.
