What is the legal process for commercial disputes?
Commercial disputes in the state of Georgia are handled through civil litigation court proceedings. These disputes are typically resolved based on either contract law or tort law. When a dispute arises between two parties, they must first attempt to resolve the issue without going to court. This is called a negotiation process, which may involve the parties discussing the dispute in person, over the phone, or by letter. If the parties cannot come to an agreement, then the dispute may need to be taken to court. The legal process begins with each party filing a complaint against the other in civil court. The complaint must include information about the dispute and a request for legal relief. Both parties will then be given the opportunity to present their case in court. The judge or jury will consider all evidence presented by both parties and make a decision. The decision of the court will be legally binding, and any party that does not comply will be subject to legal repercussions. The court may also order monetary compensation or other relief to be paid to one or both parties. In some cases, the parties may agree to use an alternative dispute resolution process such as mediation, arbitration, or a neutral third-party to help resolve the dispute without going to court. This process can be quicker and less expensive than litigation. No matter the process used, it is important to follow the legal process for commercial disputes in order to maintain a healthy business relationship and ensure that both parties’ rights are protected.
