What is the legal process for commercial disputes?
In Washington, when a commercial dispute arises between two parties, the legal process for resolving the dispute begins with the filing of a complaint with the court of law. The complaint must be both in writing and filed with the court in order to initiate legal proceedings. The court will then send a notification of the complaint to the other party. The other party then has the opportunity to respond to the complaint. Typically, the response must be written, and the other party must provide the court with any necessary documents to support their side of the dispute. Once the response is received, both parties may engage in discovery proceedings, where each side can collect evidence, testimony, and other pertinent information needed to prove their case. After the discovery process is complete, both parties can then file motions to the court and present their case in more detail. The court will then rendered a judgement based on the evidence and information presented. The judgement is binding on both parties. If one side believes the judgement to be unfair, they may appeal the judgement to a higher court. Depending on the complexity of the dispute, the entire legal process can take anywhere from a few months to several years. It is important for each party to understand their rights and obligations under the law when involved in any commercial dispute in Washington State.
