What is the law of negligence?

Negligence is a legal concept in commercial law that deals with the duty of care that entities owe to each other. It is an important part of Arizona law because it sets a standard of behavior for businesses that operate within the state. Under negligence law, any persons or businesses engaging in activities that create unreasonable risks of harm to others have a duty to act responsibly and take precautions to avoid harm. Negligence is determined by the courts on a case-by-case basis. Generally, for an entity or individual to be found liable for negligence, four elements must be present: duty, breach of duty, causation, and damages. Duty is the obligation to act with reasonable care, meaning conduct that is appropriate for the situation. Breach of duty is when an individual or business fails to act with reasonable care and falls below the expected standard. Causation is the link between the defendant’s negligent conduct and the resulting harm. Finally, damages are the losses suffered by the injured person or party. In Arizona, the court will evaluate the facts of the case in order to determine if the individual or business was negligent. If the court finds the defendant negligent, then the plaintiff may be awarded damages in the form of monetary compensation. Negligence, then, is an important part of Arizona commercial law as it sets a standard of behavior for businesses and individuals operating in the state.
