What is the definition of professional negligence?

Professional negligence is a type of civil law that is applicable in New Jersey. It is a cause of action made by a client against a service provider for failing to provide professional services that meet the accepted standard of care, resulting in harm to the client. Professional negligence is also known as malpractice or breach of duty. To prove professional negligence in New Jersey, the plaintiff must establish four key elements: the service provider had a professional duty to the plaintiff; the service provider breached that duty; the breach caused harm to the plaintiff; and the plaintiff suffered damages as a result. The standard of care imposed on service providers is based on the type of service being offered and the specialized knowledge and skills required of the service provider. Generally, service providers need to perform as a reasonably competent professional in order to meet this standard. The most common types of professional negligence in New Jersey include medical negligence, legal negligence, and product liability. If a plaintiff is successful in proving professional negligence, they may be able to obtain damages from the responsible service provider. Damages can include medical bills, lost wages, pain and suffering, psychological distress, and loss of companionship.
