Who is responsible for paying for repairs and maintenance in the condo complex?
In Washington, the Condo Act states that the condo association is responsible for repairs and maintenance of the common elements of the condo complex. Common elements include the building structure, exterior walls, and common areas. The condo association is responsible for making sure these common elements of the complex are in good working condition and well maintained. The association is responsible for the costs of maintaining and repairing the common elements, which is paid for by the association members through the monthly assessments collected. The condo owners are responsible for the maintenance and repairs of the individual units they own, such as the interior walls and fixtures. However, if the repairs to the common element of the complex are the result of damage caused by the individual condo owner, then the owner will be responsible for the repair costs. In addition, the condo association may also require that unit owners pay for any liability caused by their unit. This can include damage caused to other units as a result of the owner’s negligence. In either case, the condo association will typically require that the owner get the repairs done in a timely manner and meet certain standards set by the association.
