In California, the process for electing a new condo board is regulated by the state’s Davis-Stirling Common Interest Development Act. To begin, it’s important to understand that condo boards are comprised of members who are elected annually by the condominium’s homeowners. The elections process begins with the filing of a Notice of Election. This document must be filed with the office of the county recorder at least 30 days before the election. The notice must include a list of the positions up for election, as well as the date, time, and place of the election. Once the Notice of Election is filed, the condo board must create a list of eligible voters. Homeowners interested in running for a seat on the board must submit a written application at least 14 days before the election. Once all applications are received, the condo board must compile a list of all candidates and publicize it in the form of a call for the election. This call must be made at least seven days before the election and must include the location, date, and time of the election. On the day of the election, only those voters on the list of eligible voters may participate. The board chairperson supervises the voting process, and each ballot is counted and tabulated in front of the voters. Once all votes have been counted, the board chairperson declares the results and the newly elected condo board is formed.
