What is the process for collecting outstanding condo fees from delinquent owners?
In Florida, delinquent condo owners are required to pay their outstanding condo fees once they have entered into delinquency status. The process of collecting these fees begins with sending the delinquent owner a Notice of Delinquency. This notice serves as a demand for payment and sets a specific date by when the owner must pay all outstanding fees. If the owner does not respond to the notice, the condo association can then proceed to sue the delinquent owner in court. During the lawsuit, the court will determine the amount of the outstanding fees and set the terms for repayment. If the court rules in favor of the condo association, the delinquent owner will be responsible for repaying the full amount of the outstanding condo fees, plus any interest and court costs. In addition, the court may also impose additional penalties or place a lien against the delinquent owner’s property. Once the delinquent owner has paid off the outstanding fees and any additional charges, the condo association’s lien is released. It is important to note that the condo association cannot evict a delinquent owner, nor can it force the sale of the delinquent owner’s condo in order to collect fees. However, the condo association can take certain legal measures, such as cutting off services or filing a judgment against the delinquent owner, that will ultimately lead to the collection of the fees.
