Are there limits on how much I can increase my condo association dues?
In Texas, condo association dues, or assessments, may increase as long as the association follows the rules set forth under Texas condominium law, which is enforced by the Texas Department of Housing and Community Affairs. Generally, the association must get a majority of unit owners to approve a dues increase, as stated in the association’s condominium declaration. This document includes information related to the association’s dues, when they can be increased, and how they are used. The association also must provide notice of the dues increase to all unit owners before the increase goes into effect. The notice contains the amount of the increase, the reason for the increase, how it will be used, and the date it will be effective. In some cases, an association may increase dues with no prior notification if the association’s declaration allows for a percentage increase without member approval. Though condo associations must follow the laws set forth for dues increases, each association can set different limits on how much dues are increased. This is why it is important for potential condo owners to carefully read the declaration, rules, and regulations of the association before buying. If a condo owner/member is not happy with the dues increase, they can file a complaint with the TDHCA or take the association to court.
