How do I report copyright infringement?
If you believe that your copyrighted work has been infringed upon in Arizona, you should report the infringement to the U.S. Copyright Office. To do this, you must file a complaint, called a “Notice of Infringement,” with the Copyright Office. This Notice should include information about the copyrighted work that has been infringed upon, the contact information of the alleged infringer, and any material that proves the originality of your work. Once the Copyright Office receives your Notice and determines it is complete and in compliance with the Digital Millennium Copyright Act (DMCA), they will provide you with a Return Receipt and send a copy of the Notice to the alleged infringer. The accused party will then have the opportunity to respond to the Notice. If the alleged infringer does not dispute or respond to your Notice, then you may file a lawsuit in federal court for infringement of your copyrighted work. To do this, you must first register your copyrighted work with the Copyright Office. If the alleged infringer disputes your claim of infringement, then you and the infringer should use a dispute resolution procedure, such as negotiation, mediation, or arbitration, to resolve the dispute and avoid litigation. Regardless of whether you decide to file a lawsuit or use a dispute resolution procedure, it is important to keep detailed records of all correspondence related to the infringement. This may be helpful if you decide to take legal action against the infringer.
