What is the DMCA takedown notice?
The Digital Millennium Copyright Act (DMCA) Takedown Notice is a notification that a person or company has to send to a website or internet service provider in order to have material taken down that is believed to be infringing on a copyright. This notice is typically sent by the copyright holder or an agent authorized by the copyright holder. The notice must include a statement from the copyright holder that the material infringes on their copyrighted work and must provide contact information so that the website or service provider can contact them. In Nebraska, the DMCA takedown notice must be sent to the owner or agent of the website or service where the infringing material is located. The notice must include the web address of the material and identify it as infringing on the copyright holder’s rights. The notice should also list the contact information for the copyright holder and provide a statement that the copyright holder has a good faith belief that the material is infringing on their copyright. Once the notice is sent to the website or service provider, the material must be taken down or access to it blocked until the copyright dispute is resolved. If the website or service provider fails to take down the material or block access, they can be held liable for copyright infringement.
