Can I copyright a recipe?
Generally speaking, no. Copyright law is a form of intellectual property protection that applies to original works of authorship, such as literature, music, art, and film. Copyright does not typically cover ideas, concepts, systems, or methods of operation, such as recipes. In Oklahoma, United States copyright law governs the protection of recipes. The U.S. Copyright Office does not register culinary works or recipes. The elements of a recipe-including its ingredients and instructions-may be protected by copyright, but the protection does not extend to the idea/concept of the recipe itself. Additionally, recipes that are considered “useful articles” may not be subject to copyright protection. Individuals may, however, be able to protect their recipes as trade secrets. A trade secret is information that has commercial value as a result of being kept secret. An example of a trade secret could be the recipe for your grandmother’s secret sauce. In order to be considered a trade secret, the recipe must be kept secret and not be generally known to members of the industry or marketplace. While copyright does not protect recipes, individuals may be able to protect their recipes as trade secrets. Additionally, individuals may be able to register their recipe as a trademark or patent depending on the particular situation. Ultimately, it is important to consult with an attorney to determine the best option for protecting a unique recipe.
