What is copyright law enforcement?
Copyright law enforcement is the process of ensuring that the protections offered to copyright holders are respected and enforced. In California, copyright law enforcement is the responsibility of both state and federal governments. The Digital Millennium Copyright Act (DMCA) is one of the most important pieces of copyright law enforcement in the state. The DMCA provides copyright holders with a way to file a complaint for online infringement of their works. In response to the complaint, the ISP or content provider hosting the unauthorized material must remove the infringing material or disable access to it. Violators of the DMCA can face civil liability and criminal penalties. The U.S. Department of Justice is also actively involved in copyright law enforcement in California. The department pursues copyright violations that involve the streaming of unauthorized content, such as movies and TV shows, by launching criminal investigations and working with state and local law enforcement. In some cases, copyright holders can seek remedies from violators through civil lawsuits. Through such lawsuits, they can seek money damages, permanent injunctions, and/or the destruction of infringing material. Finally, copyright owners can also register their works with the U.S. Copyright Office and enforce their rights through that administrative process. This involves the submission of a Registration Application and the payment of a fee to the Copyright Office. Once the registration is approved, the copyright is officially recognized and can be enforced.
