What is the copyright fair-use doctrine?
The copyright fair-use doctrine is an important part of copyright law in Washington and across the United States. The doctrine allows for the limited use of copyrighted material without obtaining permission from the copyright holder. This limited use applies to things such as educational purposes, commentary, news reporting, satire, and parody. Fair use does not mean that any use is allowed, however; under the fair use doctrine, the use of copyrighted material must pass a four-factor test to determine if it is allowed. The four-factor test takes into account four things: the purpose and character of the use, the nature of the copyrighted work, the amount and substantiality of the portion used, and the effect of the use on the potential market for or value of the copyrighted work. The purpose and character of the use means that the use should be for a non-commercial purpose, and that it should be a fair and transformative use. The nature of the copyrighted work will also be considered, as certain types of works are more sensitive to copyright infringement than others. The amount and substantiality of the portion used will consider how much of the copyrighted work is being used, and the effect of the use on the potential market for or value of the copyrighted work will take into account whether the use is harming the potential market for the original work. In the end, the fair use doctrine attempts to balance the rights of copyright holders with the public’s right to use copyrighted works for educational, creative, and transformative purposes. It is an important part of copyright law and helps protect the rights of both individuals and businesses.
