What is copyright infringement liability?
Copyright infringement liability is a legal concept that applies when someone uses copyrighted material without permission from the copyright owner. In Florida, a copyright infringement liability can arise when someone uses a copyrighted work without proper authorization from the copyright owner. This unauthorized use can be direct, such as when a person knowingly copies a work without permission, or indirect, such as when a person unknowingly distributes a work without permission. In the case of copyright infringement, the copyright owner can sue for damages incurred as a result of the infringement. These damages can include actual damages, such as lost profits, and statutory damages. Statutory damages are preset amounts determined by the court as awards to the copyright owner. Additionally, the copyright owner may be able to obtain an injunction that prevents the infringer from further using the work. When someone is found to be liable for copyright infringement, it is important to understand their rights and obligations. A court can order an infringer to pay attorney’s fees, pay damages to the copyright owner, or even be subject to criminal proceedings. Therefore, it is important for a person to seek legal advice if they believe they are at risk of being held liable for copyright infringement.
