What is the difference between copyright and trademark infringement?
Copyright and trademark infringement refer to the unauthorized use of someone else’s creative work and identity. Copyright infringement is defined as the unauthorized use of another person’s original work without permission. This includes copying, publishing, displaying or selling someone’s creative work without their consent. In North Dakota, copyright infringement is punishable by devastating consequences, such as a jail sentence and/or Statutory Damages. Trademark infringement takes place when someone uses another person or organization’s symbol, logo or phrase to represent themselves or their products without permission. This type of theft is considered more serious than copyright infringement because it is a direct misuse of someone else’s identity and reputation. Trademark infringement is punishable by monetary damages, an injunction to cease the infringement, and/or Statutory Damages. In conclusion, both copyright and trademark infringement are forms of intellectual property theft. The primary difference between the two is that copyright infringement relates to unauthorized use of a creative work, whereas trademark infringement relates to unauthorized use of someone else’s identity and branding. In North Dakota, both forms of infringement are punishable by Statutory Damages and/or jail time.
