In California, the process for filing appeals in criminal defense cases begins when either the defendant or the prosecution notifies the court of their desire to appeal. Depending on whether the defendant or the prosecution is appealing the ruling, the appellant will submit a Notice of Appeal and a Documentary Exhibit as part of the appeal process. The appellant must provide copies of all the documents to both the trial court and the District Court. Once the Notice of Appeal has been submitted, the appeals process in California consists of two stages: a briefing stage and an oral argument stage. In the briefing stage, the appellant and the respondent will submit briefs with the facts and arguments relevant to the appeal.
