The sentencing process in criminal defense law is the process of determining the appropriate punishment for the offense committed. Following a conviction, the court will consider the sentencing options available to it. In the case of a misdemeanor conviction, the sentencing range may include fines, probation, community service, jail time, or combinations of these. In the case of a felony conviction, the sentencing range may include prison sentences, probation, fines, and community service. Aggravating factors are those which typically increase the severity of the punishment, such as the use of a weapon or committed in a public place. Mitigating factors are those which typically reduce the severity of the punishment, such as mental health or addiction issues. Finally, in some cases a judge may impose a mandatory minimum sentence due to certain factors such as repeat offenses, or a dangerous suspect. Mandatory minimum sentences are those in which the court may not reduce the sentence, even if mitigating factors are present. Once the sentencing process is complete, a sentence is imposed and the criminal defendant is expected to abide by all the requirements set by the court.
