What is a delay in payments?
A delay in payments is when an individual or a business has not paid a debt by the agreed upon date. This can be either a missed or partial payment. In cases of a missed payment, the creditor can take legal action to recover the debt. In Texas, creditors rights law dictates that a creditor can pursue a variety of remedies if the debt has not been paid. A creditor can declare the debt due in full immediately, take legal action to secure the debt, negotiate a payment plan, or seek legal remedies such as wage garnishment or a lien on the debtor’s property. It is also important for the debtor to understand their rights and what kind of legal protection is available. If a creditor or debt collection agency tries to harass or intimidate the debtor in any way, it is considered illegal and the debtor should contact a lawyer for guidance. If the debt is being handled by a debt collection agency, the debtor has the right to dispute the debt or negotiate a payment plan before legal action is taken. The debtor may also be able to negotiate a reduction in the amount owed or have the debt removed from their credit report. In most cases, creditors and debt collection agencies will prefer to try to negotiate a payment plan or agreement to settle the debt before taking legal action. This is also an option available to the debtor and it is important for them to understand the terms and conditions of any settlement or payment plan they agree to.
