What is a priority claim?

A priority claim is a type of debt that is given higher priority than other types of debt. In Tennessee, priority claims generally refer to certain taxes and debts that are owed to the government. Priority claims typically have two types of protection within the law. The first type of protection ensures that the debt is paid before most other debts. The second type of protection provides a set amount of money that must be paid first before any other debt. This amount is known as the priority amount. When creditors attempt to collect debt, they must pay priority claims first. Priority claims must also be fully satisfied before creditors can collect payment for any other debts. This rule is intended to help ensure that the government and other creditors are able to receive the money they are owed. If creditors attempt to collect payment for a priority claim before all other debts, the debtor could file a claim in Tennessee court. Tennessee allows the debtor to receive compensation for any damages caused by the creditor’s actions. This includes any fees or interest that was charged for collecting the debt and any legal fees that were incurred by the debtor. Creditors must also satisfy all priority claims before they can file a lawsuit against the debtor. If a lawsuit is filed, the debtor will be able to present their priority claim to the court and seek compensation for any damages caused by the creditors’ actions.
