What is a claim for child support?

A claim for child support is a creditor’s right to seek payment of child support from an obligated parent. Under Alaska law, a claim for child support is an obligation to support children for whom a parent has a legal responsibility. The claim may be established through a court order, a facility order, an agreement between the parent and the other parent or an administrative order. A claim for child support is separate from the other parent’s obligation to pay any other amount of money for the support of the child. This includes medical, educational or other costs associated with the child’s well-being. A claim for child support does not include the other parent’s obligation to provide health or life insurance, vacation or holiday expenses, or any other expenses that do not directly benefit the child. In Alaska, a creditor, typically the Department of Child Support Services, can file a claim for child support without the other parent’s consent. The claim is a civil action in which the creditor must prove that the other parent is the legal parent, and provide evidence that the other parent is obligated to provide child support. If the other parent does not cooperate, the court may order the other parent to provide child support or the creditor can garnish the parent’s wages. A successful claim for child support will provide a dependable source of money for the child’s care, education, health, and other needs. Upon the claim’s payment, the creditor will often be able to take steps to ensure that the obligated parent continues to meet his or her obligations in the future.
