What is a claim for child support?
A claim for child support is a legal document filed with the courts in Florida that allows an individual to seek financial assistance from a parent or guardian for the care and support of their children. The party requesting the assistance is referred to as the claimant. Under creditors’ rights law, the claimant must prove that the parent or guardian has the financial means to support the child and that the child would be deprived of a basic standard of living without the financial assistance. This assessment usually takes into consideration the income of both parties, the cost of raising a child, and any additional expenses associated with caring for the child. The court may also consider any special circumstances that might affect the child, such as medical expenses or educational costs. The court will then issue an order outlining the amount of child support that must be paid and the payment schedule.
