What happens if the cruise ship was not properly maintained and an accident occurs?

If a cruise ship accident occurs because the ship was not properly maintained, the passengers may be able to seek legal action against those responsible for maintaining the ship. Depending on the nature of the accident, multiple parties may be held liable for any harm that was caused. In North Carolina, the laws governing cruise ship accidents are different than the laws governing automobile or airplane accidents. If a cruise ship accident results from an act of negligence on the part of the cruise line or its employees, the cruise line can be held liable for any injuries or damages that were caused. North Carolina law also recognizes a legal concept called “strict liability,” which means that the cruise line is responsible for any accident that occurs regardless of whether or not it was negligent. In addition to the cruise line, any third parties who maintained the ship can also be held liable for any injury that occurs. These third parties may include the manufacturer of the ship’s components, the crew, and the port of call. When an accident occurs due to an act of negligence or strict liability, injured passengers may be able to seek compensation for their medical bills, lost wages, pain and suffering, and other damages. In order to be successful in a case against a cruise line or other third parties, the victims must be able to prove that the accident occurred due to the negligence or strict liability of the liable parties.
