What is a nondischargeable debt?

A nondischargeable debt is a debt that cannot be eliminated in a Chapter 7 bankruptcy case in Washington. It is a debt that still must be paid, even after a debtor files for bankruptcy protection. In Washington, certain types of debt are specifically identified as nondischargeable. These include debt incurred through fraud or misrepresentation, court fines and penalties, debt from divorce or separation agreements, and most student loan debt. Debts related to personal injury caused by the debtor’s drunk driving are also usually nondischargeable. Further, even if a debt is not specifically identified as nondischargeable, the court may still declare it to be so if it meets certain criteria. In general, creditors have the right to petition the court to have a debt declared nondischargeable. If they are successful, the debtor must continue to pay the debt, as it cannot be eliminated in the bankruptcy. It is important for debtors in Washington to be aware of the types of debts that are usually considered to be nondischargeable. Knowing this can help them to make informed decisions about filing for bankruptcy.
