Can Chapter 7 Bankruptcy relieve me from child support obligations?

Chapter 7 Bankruptcy can relieve a person from many debts, but unfortunately, it cannot relieve them from child support obligations. This type of debt is usually not eligible for discharge under the Bankruptcy Code and must still be paid in full. In Maryland, when someone files for Chapter 7 Bankruptcy, all the debts, with the exception of child support, are discharged. This means the debtor no longer has a responsibility to repay the debts. A person is not allowed to file for bankruptcy in order to avoid their obligation to pay for child support. The court generally requires the debtor to keep up with their payments, even during the bankruptcy process. Since child support is meant to provide for the well-being of the children and is not considered a type of debt, filing a Chapter 7 Bankruptcy will not render it void. Furthermore, the bankruptcy court often requires the debtor to at least continue making their payments and can even require them to make a lump-sum payment to the child support arrearage. Therefore, while Chapter 7 Bankruptcy can provide debt relief for many debts, it cannot provide relief from child support obligations. The individual may still be responsible for making payments, regardless of filing for bankruptcy. It is best to consult a local attorney to better understand the specifics of the law in Maryland.
