Can Chapter 7 Bankruptcy relieve me from child support obligations?
In North Carolina, Chapter 7 bankruptcy does not relieve you from child support obligations. Chapter 7 Bankruptcy, otherwise known as liquidation bankruptcy, provides temporary financial relief by allowing filers to discharge certain unsecured debts like medical bills and credit card debt. Chapter 7 does not, however, prevent or delay the collection of debts which are considered “secured” or “priority,” which includes child support payments. This means that while filing for Chapter 7 bankruptcy will help alleviate debt, it will not stop creditors from pursing collections, including child support payments. In fact, the court may require filers to make payments on child support debts as part of the court’s approval of a payment plan. Additionally, because child support payments are non-dischargeable, creditors can still take legal action to recover debt after a bankruptcy is complete. If you are having difficulty making your child support payments, there are other options available to you. In North Carolina, you can contact the local child support office to discuss the possibility of modifying your payment amount. They may be able to negotiate a payment plan that is more manageable for you. Additionally, you may also be eligible for assistance from state agencies that provide cash assistance or other relief for those struggling to make timely child support payments.
