What is a discharge order?

A discharge order is a legal document which is issued by the court when a debtor completes their Chapter 7 Bankruptcy in Idaho. This document releases the debtor from any personal liability for the dischargeable debts that were listed in the bankruptcy petition and prevents creditors from taking any collection action against the debtor. The discharge order is a binding and final order that offers the debtor protection from the claims of creditors and other parties that were listed in the bankruptcy petition. The discharge prevents creditors from taking any further legal action or attempting to collect on the debt from the debtor. In Idaho, a discharge order may include all or part of the debts that a debtor listed in their bankruptcy petition. However, the order does not discharge taxes, student loans, fines, penalties, and other non-dischargeable debts. Additionally, the order does not protect against judgments that are not part of the dischargeable debts, such as divorce judgments or child support awards. Once the discharge order is issued, the debtor is released from certain debts and is no longer responsible for paying them. The discharge order is an important step in helping a debtor achieve a fresh financial start following a Chapter 7 Bankruptcy.
