What is a discharge order?
A discharge order is a court order that is issued as part of a Chapter 7 Bankruptcy case in Tennessee. The discharge order is a document that wipes out the legal obligation of the debtor (person who filed for bankruptcy) to pay back certain debts. Once a discharge order is issued, the debtor is no longer legally responsible for paying back those debts. The discharge order is issued by the court after all of the debtor’s assets have been sold and the proceeds have been distributed to the creditors in accordance with the court’s directions. Any remaining debts that cannot be paid off with the proceeds are then wiped out by the court and the debtor is no longer legally obligated to pay them back. The discharge order is important to the debtor because it serves as a legal document that releases them from financial obligation. The order is binding and any creditors who receive the discharge order are not allowed to attempt to collect the debt from the debtor. The discharge order also serves as a proof that the debtor fulfilled their obligation to pay back the debts to the best of their ability and they are now released from the legal and financial obligation.
