What is a discharge order?

A discharge order is a court order that releases a debtor from the financial obligations associated with debts included in a Chapter 7 bankruptcy filing. This order is issued by the court once the creditor has received the amount of money owed, or the court has determined that there is no money available to repay the debt. In West Virginia, a discharge order will be issued after the debtor has successfully completed the requirements for filing a Chapter 7, such as filing all necessary paperwork and attending the required bankruptcy counseling sessions. A discharge order eliminates the debtor’s legal obligation to repay the debts included in the bankruptcy filing. The debts that are discharged in a Chapter 7 bankruptcy, such as credit card debt and medical bills, cannot be pursued further by the creditors. However, certain debts, such as student loans, taxes, and child support, may not be discharged in a Chapter 7 bankruptcy filing. Once the debtor in West Virginia has received a discharge order, they will no longer be responsible for repaying the debts listed in the bankruptcy filing. The order does not affect the creditor’s right to collect the debt from any other party, such as a co-signer. Additionally, a discharge order does not prevent the debtor from being liable for any other new debts they may incur after the bankruptcy has been discharged.
