Will I have to appear in court to file for Chapter 7 Bankruptcy?

In Idaho, you will not have to appear in court in order to file for Chapter 7 bankruptcy. Most of the paperwork for a Chapter 7 bankruptcy can be filled out online and you will not need to appear in court. However, you will be required to attend a brief hearing known as a Meeting of Creditors, which is held approximately one month after filing. The purpose of the hearing is for a trustee appointed by the court to verify your income, review the documents you submitted, ask questions about your bankruptcy case, and determine whether it will be approved. Although it is not typically required for you to attend, the hearing may be cancelled if you do not appear. Additionally, during the Meeting of Creditors, you will be asked to swear under oath that the information you provided in your bankruptcy filing is accurate and that you completed the forms truthfully. It is important to be as honest and candid as possible during this hearing, as the court takes any false or misleading statements very seriously. If you find that you will not be able to make the Meeting of Creditors, you may be able to request an adjournment from the court. This will allow you to reschedule the hearing without having to redo the paperwork. Keep in mind, however, that an adjournment request is not guaranteed to be approved.
