What type of visitation rights are associated with a child support order?

Visitation rights associated with a child support order in Maine depend on the custody arrangement agreed upon by the parents. In general, if one parent is granted primary custody, then the other parent will usually be granted visitation rights. These visitation rights can be as often and as long as the custodial parent allows within reason, or as outlined in the court’s custody order. Generally, if the parents are unable to agree about the visitation rights, the court may order a reasonable amount of visitation with the non-custodial parent. If the non-custodial parent has been paying child support and is held in high regard by the court, they may be given additional visitation rights such as overnight visits with the child. This additional visitation is often granted in order to encourage the contribution of child support payments. The court may also order that the non-custodial parent pay for the cost of travel for both the parent and child in order to facilitate visitation. Although child support and visitation are two separate issues, it is not uncommon for both to be addressed in the same court order. Ultimately, visitation rights are determined on a case by case basis by the court. It is important that both parents understand the court’s order in order to ensure that their rights are protected.
