What happens if the amount of child support payable is more than the paying parent can afford?

When a paying parent is unable to pay court-ordered child support, they can file a motion called an "Application for Relief from Support Obligation." This motion can be filed in Michigan with the Friend of the Court (FOC). The paying parent can use this application to request a child support reduction from the court. When the paying parent files the Application for Relief, they must provide proof to the court that they cannot afford the court-ordered support payment. This proof may include income, assets, expenses, debts, and other financial information. The court will review this information to determine if a reduction can be granted. If the court finds that the paying parent is unable to afford the court-ordered payment, it can modify the monthly payment amount and adjust the number of payments due. The court can also modify the payment period so that the paying parent can afford the payment. The court may even decide to forgive some of the arrearage, or unpaid back payments, that the paying parent owes. If the court denies the paying parent’s Application for Relief from Support Obligation, the paying parent must continue to pay the court-ordered child support amount. However, if the paying parent’s financial circumstances change, they can file another Application for Relief and provide updated information to the court.
