Can child support payments be reduced or suspended?

In Virginia, child support payments may be reduced or suspended under certain circumstances. The court may reduce or suspend child support payments if it finds that the amount of the payments is causing a significant financial hardship or if the payer has become temporarily unemployed. The court may also, based on individual situations, reduce or suspend payments if the payer is no longer able to provide the required level of support due to an illness or disability or if the payer is paying more than what is necessary to provide for the child’s needs. Additionally, depending on the circumstances, the court may determine that a reduction or suspension of child support payments is warranted if the paying parent has changed circumstance that warrant a reduction in financial obligation. This may include if the paying parent has lost their job, if they have experienced a significant decrease in their income, or if they have had a significant increase in expenses, such as medical bills. The court must review and approve any requested changes to the existing child support payments, and the paying parent must also be able to demonstrate that the change in their financial circumstances is not temporary, or that there is an extraordinary need for a reduction or suspension of payments. Ultimately, the court will decide whether to grant a reduction or suspension based on all of the evidence provided.
