What happens if a parent receiving child support moves out of state?
If a parent receiving child support moves out of state, there could be a few different outcomes. In Michigan, both the custodial and noncustodial parents must comply with the Michigan Child Support Formula to determine the appropriate amount of support payments. In situations where one parent moves away, the court will either adjust the payments to account for the distance and cost of travel, or they will require payments to be made to an intermediary in Michigan. In addition, the court may also require that the out-of-state parent obtain an “interstate registration” with the state to which they move. This registration must be done through the Family Support Administration and will allow the court to enforce the payment of child support if the out-of-state parent fails to pay. If the out-of-state parent fails to make payments, the custodial parent may have to seek enforcement in the other state’s court system. Finally, if the out-of-state parent does not comply with the child support order, Michigan may seek enforcement of the order through the Uniform Interstate Family Support Act. This act allows communication and enforcement between two states if one state has been unable to enforce the child support order. Through this act, Michigan can request the out-of-state court to enforce the child support order and the other state must comply.
