What is a garnishment order for child support?

A garnishment order for child support is a legal document issued by a court in the state of Washington in order to collect unpaid child support from the non-custodial parent. This document requires the non-custodial parent to pay child support directly to the custodial parent, rather than to the state. A garnishment order will identify the amount of money to be paid and the method of payment. Garnishment orders are enforced by the Department of Social and Health Services and their designee. The garnishment order will include the name and address of the non-custodial parent and will include information about the amount of money owed and the due date of payment. The order may also require additional information such as wage verification, as necessary. The wage verification would be used to establish the amount owed and to determine the correct garnishment amount. Once the garnishment order has been issued, the non-custodial parent must comply with the terms of the order. If the non-custodial parent does not comply with the order, the court can take legal action, including wage garnishment, tax refunds, and/or suspension of driver’s license. The custodial parent can also seek a contempt of court action against the non-custodial parent if the garnishment order is not followed. When the garnishment order has been fulfilled, the non-custodial parent must provide proof of payment to the custodial parent and the court. If all of the financial obligations of the non-custodial parent have been fulfilled, the garnishment order will be released and the non-custodial parent will no longer be responsible for the payments.
