What is the effect of Chapter 13 Bankruptcy on my future credit?
Chapter 13 Bankruptcy can have a significant effect on an individual’s credit rating. In South Carolina, filing for Chapter 13 bankruptcy is voluntary, which means the debtor must apply for the bankruptcy with a court. Once the bankruptcy is approved, the debtor is protected from any further collection actions from creditors. While this can offer a breath of fresh air, there are still repercussions that can affect an individual’s future credit. The bankruptcy will stay on an individual’s credit report for up to seven years from the filing date, making it difficult for an individual to obtain additional credit. In addition, an individual’s credit score will suffer, as all accounts included in the bankruptcy will be reported as “closed” to the credit bureaus. However, this does not mean an individual will never be able to receive credit again. An individual can still receive credit, albeit at a higher interest rate than before the bankruptcy filing. Ultimately, Chapter 13 Bankruptcy can have a lasting effect on an individual’s credit. While it can be beneficial in the short-term, the long-term consequences can be a challenge to manage. It is important for an individual filing for bankruptcy to create a plan to help rebuild their credit, such as budgeting, saving, and avoiding additional debt.
